Kimberly L. Cunningham focuses her practice on the representation of schools, colleges, and other entities.  Ms. Cunningham has a special interest in employment law and regularly handles matters in state and federal court involving employment discrimination, harassment, wrongful termination, the Fair Labor Standards Act, whistleblower laws, and other labor laws.  Ms. Cunningham also assists clients with drafting employment agreements and developing employment policies, programs, and handbooks that comply with federal and state law.   Ms. Cunningham also assists clients with compliance with the Texas Public Information Act.

Ms. Cunningham has extensive experience representing clients in both state and federal court and before the Equal Employment Opportunity Commission, the United States Department of Education, the United States Department of Justice, the Texas Workforce Commission, and the Texas Education Agency in matters involving alleged age, race, gender, national origin, and disability discrimination; harassment; retaliations; wrongful discharge; wage and hour disputes; family and medical leave; voting rights; and desegregation.

In addition to her litigation practice, Ms. Cunningham assists clients with policy manual development, preparation and review of business contracts and employment contracts, and compliance with ethics and conflict of interest laws.  She also regularly provides training on employment law and legal issues affecting students.

Prior to joining Thompson & Horton LLP, Ms. Cunningham was an attorney at Bracewell & Giuliani LLP in the School & Public Law Section.
