New Legal Protections for Pregnant Students and Employees

This summer, new federal mandates will expand legal protections for students and employees who need accommodations relating to pregnancy, childbirth, and related conditions. On April 28, 2023, the new legal remedies for violations of the PUMP Act will go into effect. The Act expands legal protections for nursing mothers at work. On June 27, 2023, the Pregnant Workers Fairness Act goes into effect. At that time, the EEOC will start accepting charges of discrimination from employees under the PWFA for complaints of actions that occur on or after June 27, 2023. The PWFA and Pump Act require implementation of new campus procedures.

In addition, this summer, we anticipate that the new Title IX rules will be announced. The anticipated rules will contain new requirements relating to pregnancy and parenting for both students and employees. The new Title IX rules will likely go into effect prior to the start of the 2023–2024 academic calendar year.
